Padstal Namibia's General Terms and Conditions

  1. General


The following Terms and Conditions apply to all orders placed by the customer with Padstal Namibia Online Products (hereinafter “Padstal”). By placing an order with Padstal you agree to the following Terms and Conditions. Please make sure you have read and understood these Terms and Conditions before placing your order. 


The inclusion of any products on (hereinafter “the Site”) at a particular time does not imply or warrant that these products will be available at any or all times. Padstal reserves the right to discontinue any product or to cancel your order, or parts thereof, due to technical reasons or products becoming unavailable. 


Padstal further reserves the right to alter or amend these Terms and Conditions from time to time as the need arises without prior notice to the customer. The version of the Terms and Conditions that will apply to the customers order will be those on at the time the relevant order is placed. 


In order to ensure that Padstal gives customers the best online experience possible, the customer agrees not to:


(i) Act in a manner or employ any device that would restrict, impair, interfere or inhibit any other user from using or enjoying the Site, or which impacts the security of the Site;

(ii) Use any device, virus, malware, tool, agent, mechanism, hardware, artificial intelligence or bots to navigate the Site, copy content from the Site, place orders on the Site, or otherwise impair the proper functioning of the Site;

(iii) Use any obscene, indecent, or offensive language or to provide or post on or through the Site any graphics, photographs, images, video, audio or other material that is defamatory, abusive, constitutes bullying, harassing, racist, hateful or violent. The customer shall not use any ethnic or racial slurs, convey religious intolerance, homophobia or personal attacks when using the Site;

(iv) Post on or through the Site any graphics, text, photographs, images, video, audio or other material, encrypted or not, that invades anyone’s privacy or illustrates, references or encourages conduct that would constitute a criminal offence, give rise to criminal liability or that otherwise violates any statute or regulation. The customer agrees to only use the Site for lawful purposes and acknowledges that any failure to do so may result in civil or criminal action being taken by Padstal. 

Padstal reserves the right to immediately bar access to the Site and close the account of any user who violates this provision or any other provision in these Terms and Conditions. The customer agrees that any termination of its access to the Site may be effected without prior notice, and the customer acknowledges and agrees that Padstal may immediately deactivate or delete its registration and all related information and files under its registration and bar any further access to such files or the Site. 


The customer further agrees that Padstal shall not be liable to it or any third-party for any termination of its access to the Site.


2. Prices and delivery charges 


All prices displayed on the Site are non-negotiable and are determined by the vendor, and subjected to a mark-up by Padstal. All prices are shown in Namibian Dollars.


Delivery within Windhoek, not including surrounding areas such as Finkenstein Estate, Omeya, Brakwater or Elisenheim, shall be free of charge. Delivery to the surrounding areas shall be free of charge where the order exceeds N$500.00 (Five Hundred Namibia Dollars) in value. 


The delivery charge for each order may vary depending on the size or weight of your order. An estimated cost for each delivery is indicated during the check-out process. There may be additional charges if Padstal has to make more than one delivery on a given order.


3. Ordering

Once you have placed your order, you will receive an email confirmation provided you have given Padstal this information. If, for any reason, we are unable to fulfil your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, Padstal will notify the customer and request any additional information as may be necessary to settle the refund. 


4. Delivery


Padstal exercises the utmost diligence in accepting and processing orders, and will endeavour to deliver your order to your chosen address in the Republic of Namibia. Though Padstal aims to deliver within the communicated time frame, delivery may take longer due to unexpected events, or logistical or technical difficulties. In the unlikely event that your delivery exceeds 30 days from the communicated date of delivery, the customer may cancel the order. 


Padstal Namibia will endeavour to ensure that all goods ordered by you are supplied to you. However, please be aware that our stocks can fluctuate throughout the day due to sales demand, so an item indicated as “in stock” when you place your order may, in fact, be out of stock. Unfortunately, we cannot process back-orders, so in this event, we will make every effort to contact you by email or phone immediately to notify you of the lead time.


In this circumstance we will also offer you various options including:

a) cancel the order in return for a full refund;

b) accept a substitute product (price differences will be calculated);

c) accept no substitute and retain a credit towards your next purchase.


Padstal reserves the right to cancel any order for any reason whatsoever. Should this happen, any amounts already paid by the customer shall be refunded to the customer. 


5. Cancellation of the order


If you wish to cancel or change an order, please get in touch with Padstal as soon as possible. If the order has not been dispatched, Padstal will endeavour accommodate your changes. 


If you wish to cancel an order, a full refund will be issued, minus any transaction and/or other applicable fees incurred by Padstal due to the cancellation of the order. If your order has already been dispatched you will be unable to cancel your order.


6. Returns


Padstal shall refund any returned items provided that all returned items are returned in the same condition they were in when delivered to the customer. The returned items should not be damaged, soiled, washed, altered or worn, consumed, and any labels or tags should be intact. 


7. Payment methods 


Padstal shall only process orders if a payment method is confirmed and approved. Padstal accepts payments in the following forms:





Padstal reserves the right to check the validity of any Paypal account used for payment. Padstal further reserves the right to check whether the relevant Paypal account has sufficient funds to cover the purchase sum. 


Promo code 


The customer can choose to pay the whole or part of the purchase sum with promo codes.

Where payment is made by EFT, the order shall only be dispatched when a valid proof of payment is received by Padstal


Cash on delivery 


The customer can make payment in cash on delivery. When this payment method is used, the cash payment shall be made to the Padstal delivery person, who shall then issue an invoice. Padstal will not accept cash on delivery payments over N$ 2000  (Two Thousand Namibian Dollars).




Payment by e-wallet or any similar service is also accepted. In this case, delivery shall be effected once confirmation of the relevant payment has been received. 


Credit or debit card 


The customer can enter their payment details at the time an order is placed using a valid credit or debit card. The applicable amount will be reserved on your card and debited once the relevant items are dispatched. Padstal reserves the right to check the validity of the card used, its credit status in relation to the order. Padstal may refuse order depending on the results of these checks. 


Note: this payment method is not currently accepted but it may become accepted in the future. 


Once an order is received Padstal will get in touch via WhatsApp to confirm payment details.


8. Product disclaimer 


With regard to any and all products featured on the Site, Padstal makes no representations or warranties, either expressed or implied, of any kind, except as expressly stated herein. In no event shall Padstal, its directors, officers, employees and representatives be liable for any direct, indirect, consequential, special, exemplary or other damages related to the product sold.


Padstal aims to include in the product list up-to-date pictures of the products. At times, the pictures of the products on the product list may differ from the products actually supplied to you. The colour of a given product may depend on your computer system, and Padstal cannot and does not guarantee that your computer system will accurately display such colours. 


Padstal does not warrant the accuracy of the information contained in the product list and recommends that you read the Labels on Goods carefully before consumption.


9. Medical disclaimer


Any material provided on the Site is for information purposes only and is not intended to replace medical advice or be a treatment for any medical condition. Whilst all reasonable steps have been taken to ensure the accuracy of information provided on the Site, Padstal cannot itself verify the findings and materials which are produced by third parties and included on the Site.


Padstal does not warrant or guarantee any health benefits claimed by any third-party vendors on packaging and product descriptions visible on the Site. 


Padstal encourages customers to consult a healthcare professional if you have any concerns about your health, are starting any health or nutritional related treatment, or for any questions you may have regarding your own or any other party’s medical condition.


Padstal further encourages customers currently pregnant and/or breastfeeding, or suffering from any chronic or terminal illness, long or short-term illness, or any other illness affected by any health products displayed on the Site to consult a medical professional prior to making an order. 


10. Assignment 


Padstal reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods. 


11. Ownership of rights 


All intellectual property rights in the Site shall remain the property of Padstal and its subsidiaries or licensors. 


12. Applicable law and jurisdiction 


These Terms and Conditions shall be governed by the laws of the Republic of Namibia. 


13. Privacy and security


Padstal takes the privacy of its customers seriously. Any information uploaded by a customer shall be stored on a secure server. 


The Site makes use of cookies which collect data about the device used to access the Site. These cookies minimise the possibility of unauthorised access to, and disclosure of, your personal information. Padstal will not disclose, sell or rent your personal information to third parties without your consent unless it is compelled to do so by law. 


Whilst Padstal will take all reasonable efforts to ensure that the customer’s personal information and/or credit card details are protected, Padstal cannot guarantee the absolute security of any information provided by the customer. In this regard, the customer indemnifies and holds harmless Padstal and its affiliates, employees, agents, representatives and third-party providers for any and all claims and liabilities which may arise from the customer’s submissions on the Site.  


14. COVID-19 


Padstal will take all reasonable measures to ensure customer safety in light of the COVID-19 pandemic. However, due to the large number of vendors featured on the Site, Padstal cannot reasonably guarantee the safety of every customer, nor can it vouch for the safety procedures implemented by every vendor featured on the Site. In this regard, the customer indemnifies and holds harmless Padstal and its affiliates, employees, agents, representatives and third-party providers for any and all claims and liabilities which may arise from the customer’s use of the Site and Padstal’s delivery systems.  


Relatedly, due to the legal uncertainty caused by the COVID-19 pandemic, and the often-changing regulations applicable thereto, Padstal’s delivery times may be affected, and/or Padstal may be rendered unable to complete a given delivery until well after the predicted delivery date. Although Padstal intends to apply for essential service provider status to prevent this from happening, Padstal reserves the right to cancel any affected orders and refund any amounts already paid.
